By accessing, browsing, registering, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you should discontinue using the Platform.

 

 

1. About Aavya Living

Aavya Living is a technology-enabled multi-vendor e-commerce marketplace operating on a dropshipping business model.

The Platform connects customers with independent manufacturers, farmers, artisans, brands, and sellers across India.

Products listed on the Platform are owned, stocked, packed, shipped, and fulfilled directly by the respective sellers.

Aavya Living provides the technology platform for product discovery, order placement, payment facilitation, customer support, and dispute resolution. Unless expressly stated, Aavya Living does not manufacture, own inventory, warehouse, or directly dispatch products.

 

 

2. Eligibility

By using the Platform, you confirm that you:

  • Are at least 18 years of age or otherwise legally competent to enter into binding contracts under applicable law.

  • Provide accurate, complete, and current information.

  • Agree to comply with these Terms and all applicable laws.

 

 

3. User Accounts

To access certain features, users may be required to create an account.

You agree to:

  • Provide accurate registration details.

  • Keep your login credentials secure.

  • Maintain the confidentiality of your account.

  • Notify Aavya Living immediately of any unauthorized use.

You are responsible for all activities conducted through your account.

 

 

4. Marketplace Role

Aavya Living acts solely as an intermediary technology platform connecting buyers with independent sellers.

Accordingly:

  • Sellers are responsible for listing their products.

  • Sellers determine product pricing.

  • Sellers maintain inventory availability.

  • Sellers pack and dispatch products.

  • Sellers are responsible for product quality, certifications, warranties, and legal compliance.

Aavya Living facilitates transactions but is not the manufacturer or owner of products unless specifically mentioned.

 

 

5. Product Information

Product descriptions, images, specifications, certifications, pricing, ingredients, and other information are provided by the respective sellers.

While Aavya Living strives to maintain accurate information, we do not guarantee that product descriptions or other content are complete, accurate, or error-free.

Actual packaging, colour, size, or appearance may vary from the images displayed.

 

 

6. Pricing

All prices displayed on the Platform are in Indian Rupees (INR).

Prices may change without prior notice.

Applicable taxes, shipping charges, convenience fees, or other charges, if any, will be displayed during checkout.

 

 

7. Orders

An order placed on Aavya Living constitutes an offer to purchase products from the respective seller.

Orders are subject to:

  • Seller acceptance

  • Product availability

  • Payment verification

  • Delivery feasibility

  • Fraud prevention checks

Aavya Living reserves the right to cancel or refuse any order where necessary.

 

 

8. Partial Advance Payment

Certain products may require customers to pay a partial advance amount during checkout.

The remaining balance shall be payable upon delivery using the payment methods accepted by the seller or delivery partner.

The applicable advance amount will be clearly displayed before the order is confirmed.

 

 

9. Shipping & Delivery

Products are shipped directly by the respective sellers or their authorized logistics partners.

Estimated delivery timelines are provided for convenience only and may vary due to seller processing time, courier availability, weather conditions, public holidays, government restrictions, or other unforeseen circumstances.

 

 

10. Cancellation, Returns & Refunds

Cancellation, returns, refunds, and replacements shall be governed by the respective policies published on the Platform.

Customers are encouraged to review these policies before placing an order.

 

 

11. User Responsibilities

Users agree not to:

  • Provide false or misleading information.

  • Create multiple fraudulent accounts.

  • Attempt unauthorized access to the Platform.

  • Upload viruses or malicious software.

  • Misuse promotional offers.

  • Submit fraudulent refund or replacement requests.

  • Violate applicable laws.

12. Seller Responsibilities

Each seller agrees to:

  • Sell only genuine and legally compliant products.

  • Maintain all required licences, registrations, and certifications.

  • Dispatch orders within committed timelines.

  • Provide accurate product descriptions.

  • Comply with applicable tax and consumer protection laws.

  • Honour applicable warranties and return obligations.

 

 

13. Intellectual Property

All content available on the Platform, including the Aavya Living name, logo, website design, graphics, icons, software, text, and other proprietary materials, is owned by or licensed to Aavya Living and is protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, modified, or commercially exploited without prior written permission.

 

 

14. Prohibited Activities

Users and sellers shall not:

  • Sell counterfeit or prohibited products.

  • Manipulate reviews or ratings.

  • Engage in fraudulent transactions.

  • Violate intellectual property rights.

  • Use the Platform for unlawful purposes.

  • Interfere with the security or operation of the Platform.

Aavya Living reserves the right to remove listings, suspend accounts, or take legal action where necessary.

 

 

15. Limitation of Liability

To the fullest extent permitted by law, Aavya Living shall not be liable for:

  • Product quality or manufacturing defects.

  • Seller warranties or guarantees.

  • Delayed deliveries beyond reasonable control.

  • Loss of profits or business.

  • Third-party payment gateway failures.

  • Courier or logistics delays.

  • Indirect or consequential damages.

Our liability, where applicable, shall be limited to the amount actually paid through the Platform for the relevant order, except where otherwise required by law.

 

 

16. Account Suspension

Aavya Living reserves the right to suspend or terminate any account that:

  • Violates these Terms.

  • Engages in fraudulent activities.

  • Misuses the Platform.

  • Provides false information.

  • Repeatedly breaches marketplace policies.

 

 

17. Privacy

Your use of the Platform is also governed by the Privacy Policy, which forms an integral part of these Terms.

Aavya Living may update these Terms from time to time.

Aavya Living shall not be liable for any delay or failure in performance caused by events beyond its reasonable control, including natural disasters, pandemics, government actions, transportation disruptions, internet outages, strikes, or other force majeure events.

 

 

20. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka, India.
